- Hearing is being done on the application of Shinde faction, petition has been filed on disqualification
Maharashtra Political Crisis: The political struggle of Maharashtra has now reached the threshold of the Supreme Court. The Supreme Court is to hear on Monday the application of the rebel Shinde faction of Shiv Sena. On behalf of the Shinde faction, 15 MLAs have moved the Supreme Court. Two things are specifically mentioned in the petition. Firstly, the MLAs have challenged the Deputy Speaker’s notice to disqualify him as illegal and secondly they have demanded protection from the court for themselves and their family.
Veteran lawyer Harish Salve will represent the case on behalf of Shinde faction in the Supreme Court today. At the same time, senior advocate Abhishek Manu Singhvi will also give arguments on behalf of Shiv Sena. Devdutt Kamat will fight on behalf of the Maharashtra government while Advocate Ravi Shankar Jandhyala will fight on behalf of the deputy speaker. Two petitions have been filed on behalf of the MLAs.
2-member bench will hear
On Monday, a bench of Justice Surya Kant and Justice JB Pardiwala will hear both the petitions. 7 parties will be involved in the hearing. These include Deputy Speaker, State Legislative Assembly Secretary, Government of Maharashtra, Ajay Chaudhary (new leader of legislature party on behalf of Uddhav), Sunil Prabhu (new chief whip of Uddhav government), Union of India, DGP Maharashtra.
What did the legislators say in the petition?
The rebel MLAs have said in the petition that more than 2 third members of Shiv Sena Legislature Party support us. Even after knowing this, the Deputy Speaker appointed the new leader of the party’s legislature party on June 21. After the notice, he and his other associates are getting threats every day. His life is in danger. The other side (Shiv Sena) has not only withdrawn the security from his family, but is trying to provoke party workers again and again. It has also been said in the petition that the properties of some of the associates of the petitioner have also been damaged. It has been said in the petition of the MLAs that they have not given up the membership of Shiv Sena.
What action can the Supreme Court take?
Dozens of such cases of splitting between the government or the opposition have come to the Supreme Court so far. Based on the Supreme Court’s stand in those cases, it is expected that the Court will hardly take any action or issue notices on the subject of the Deputy Speaker’s role, appointments and disqualification. If we look at the previous hearings, the court can take steps to get milk of milk and water of water only after conducting a strength test in the house. In states like Karnataka, Goa, many times the decision did not come from the court, but from the house of the legislature itself.

Bharat Gogavale, Prakash Rajaram Surve, Tanhaji Jaywant Sawant, Mahesh Sambhajiraje Shinde, Abdul Sattar, Sandipan Asaram Bhumre, Sanjay Pandurang Sirshasati, Yamini Yashwant Jadhav, Anil Kaljerao Babar, Latabai Chandrakant Sonawane, Ramesh Nanasaheb Bornare, Sanjay Bhaskar Raimulakand, Sanjay Bhaskar, Raimulak Balaji Devidasrao Kalyankar, Balaji Prahlad Kinilkar. India has appointed Gogavale as its chief whip.

Governor wrote letters for security
Maharashtra Governor Bhagat Singh Koshyari wrote two letters demanding protection to the rebel MLAs. He wrote the first letter to the DGP of Maharashtra. In the second letter, the Governor said that provision of central security forces should be made to provide security to the rebel 47 MLAs of Maharashtra and their families.
