A Pune court on Friday late evening granted bail to Kalicharan Maharaj alias Abhijit Dhananjay Sarg in the inflammatory speech case. Last month, in Pune, Kalicharan gave an inflammatory speech, due to which he was arrested.
In this case, Pune Police arrested Kalicharan Maharaj and produced him before the court on Wednesday, from where he was sent to police custody for one day. Maharashtra Police had brought Kalicharan from Raipur in Chhattisgarh. After a day’s police custody, Kalicharan was sent to judicial custody on Thursday.
Lawyers gave these arguments
His lawyer Amol Dange had applied for bail. Opposing the bail, the Public Prosecutor said that the offense against Kalicharan was non-bailable and serious in nature. If Kalicharan is released on bail, he will try to create anarchy by taking the wrong advantage of his freedom.
Dange argued that the maximum punishment for the offense was 3 years. The police officer who arrested him had not issued any notice under Section 41A of the Penal Code, making the arrest illegal. He further said that the FIR was registered after 7 days, which created the possibility of making false allegations.
Released on bail bond of Rs 25,000
The Chief Judicial Magistrate said in his order that it will take time to complete the investigation. Till then the accused cannot be kept behind the bars. Therefore, the accused can be released on bail by imposing certain conditions. The magistrate accepted the bail application and Kalicharan was released on a surety of Rs 25,000.
